These Terms & Conditions ("Terms") form a binding agreement between you and MindPsy Guidance ("MindPsy Guidance", "we", "us", or "our") governing your access to and use of the Seven Centers System® mobile and web application and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Who we are
The Service is operated by MindPsy Guidance, doing business as "The Seven Centers System®." You can reach us at support@sevencenterslifeschool.com.
2. Eligibility & account
- You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
- If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
- You agree to provide accurate information, keep your account credentials confidential, and are responsible for all activity under your account.
3. The Service
The Service provides journaling, habit tracking, daily check-ins, and educational content related to nervous-system regulation and holistic self-development. The Service is for general educational and self-development purposes only. It is not medical, psychological, psychiatric, or therapeutic advice and is not a substitute for care from a licensed clinician. If you are in crisis or need professional help, please contact a qualified provider or emergency services.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, harassing, or harmful purpose;
- Infringe any intellectual property, privacy, or other right of any person;
- Probe, scan, scrape, reverse engineer, or interfere with the security or integrity of the Service;
- Introduce malware, spam, or automated systems that disrupt the Service or other users;
- Share your account, resell access, or circumvent paywalls, technical limits, or rate limits;
- Use the Service to make decisions about another person's medical or mental-health care.
5. Intellectual property
MindPsy Guidance and its licensors own all right, title, and interest in the Service, including the "Seven Centers System®" mark, the underlying methodology, software, documentation, written content, audio, images, and branding. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal practice while your subscription is active. Any content you create within the Service (journal entries, check-ins, notes) remains yours; you grant us a limited license to host, store, and process that content solely to provide the Service to you.
6. Subscriptions, billing & the free trial
Paid access is sold as a recurring subscription. New customers may be offered a 7-day free trial; you will not be charged until the trial ends, and you may cancel during the trial to avoid being charged. After the trial, the subscription renews automatically at the then-current price until you cancel. If your free trial has already been used on your account, future signups will not include another free trial.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles payment processing, invoicing, sales-tax calculation, customer-service inquiries related to billing, and returns. For payment, billing, renewal, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms and our Refund Policy. You can manage or cancel your subscription at any time from the Subscription page in the app, or at paddle.net.
7. Service availability
We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue features at any time. To the fullest extent permitted by law, the Service is provided "as is" and "as available," and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8. Suspension & termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our policies. You may cancel at any time from the app. On termination, your license to use the Service ends, and we may delete your account data after a reasonable retention period as described in our Privacy Notice.
9. Limitation of liability
To the fullest extent permitted by law, MindPsy Guidance and its officers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenue, data, goodwill, or use, arising out of or related to the Service. Our aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $100. Nothing in these Terms limits liability that cannot be limited under applicable law (such as fraud, gross negligence, or personal injury).
10. Indemnity
You will defend, indemnify, and hold MindPsy Guidance harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
11. Governing law & disputes
These Terms are governed by the laws of the United States and the State of Hawai'i, without regard to conflict-of-laws principles. The state and federal courts located in Hawai'i will have exclusive jurisdiction over any dispute that is not subject to arbitration or small-claims court, and you and we consent to personal jurisdiction there. Where required by your local law, your local consumer-protection rights are unaffected.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify you in the app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
13. Miscellaneous
- You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- If any provision is unenforceable, the rest of the Terms remain in effect.
- Our failure to enforce a provision is not a waiver of our right to do so later.
- Neither party is liable for delays caused by events beyond reasonable control (force majeure).
